On October 4, 1996 I was working in Mason City. I'm a self-employed

contractor. I was in Mason City working on a stucco job. During my time in

Mason City I would leave the job site and visit my mother-in-law who was in

the hospital. She was being treated for heart blockage. She and been told

that part of her heart was not working correctly/or that it would not ever

work right again. They were to do some kind of surgery on Monday. My wife

Delonna has stayed back in Cedar Falls talking care of our children.

 

I returned to Cedar Falls at about 5:00 p.m. My wife had some friends over at

the house, I just explained to her a little as to the condition of her mother

was. I spent some time with my two kids, watched some TV and about 7:15 to

7:30 got ready to leave. We had made arrangements for a baby sitter as we were

going to meet some friends. The baby sitter had got there about 7:15. I had

watched a TV show on HBO called NFL Football from 6:00 to 7:00, then took a

shower.

 

I had eaten a late lunch about 1:30. I and McDonald's in Mason. I had a

quarter-pounder with cheese, fries and a diet coke. We I was watching TV I

had some oven baked french fries that my daughter did not eat. I did not have

anything else to the rest of the night.

 

We left the house somewhere around 7:30. We went to Brooster's to meet some

friends. We met Craig and Connie Young, Bill and Lisa Bradford, Scott and

Tracie Braun. While at Brooster's I had about 3-4 beers from 8:00 PM to

10:30 PM. I did not have any alcohol to drink prior to going to Brooster's.

We were on the Brooster's side for a while and about 9:30 went over to the

Celebration's side of the business. They had band playing, I can't tell you

the name if the band. I danced with my wife I think two songs.

 

I could tell my wife was not her normal self, I believe she was thinking about

her mother. At about 10:30 we all decided to leave. My wife and I proceeded

to the parking lot. When I drove home I went to Greenhill Road and proceeded

west.

 

I was driving my 1996 Toyota 4-Runner. There was nothing wrong with our

vehicle. The lights, brakes, everything worked properly. As we were driving

down the road my wife became upset about her mother, she was asking what we

could do to help her. I think I was driving at about 40-45 mph. I was taking

my time getting home, I was in no hurry.

 

When I approached the intersection with Main St. I and a green light. There

was little or no traffic at that time on Greenhill Rd. I was close enough to

the light that when I saw it it was green. I thought I had sufficient time to

proceed. My wife was crying at the time. I was looking over at her and was

holding her hand, at that point she had her head down. As I was entering the

intersection I saw a car to my right, at that point I went to put my foot on

the brake, I do not know if I was able to. I said something like" OH Shit" or

"Oh God" and then impacted with the vehicle.

 

I do not really know what happened after impact, I kind of remember the air

bag opening. I do not know if I was knocked out for a very short time of

what. At some point after we stopped I asked my wife if she was OK. I

remember grabbing my head as it was bleeding. Somebody came up and said they

had called 911. They asked us if we were OK. I remember looking at my watch,

it was 11:10. At the point the traffic light were then blinking red for

east-west and yellow for north-south. I mad a distinct question in my mind

as to when did the light change.

 

Ambulance personnel arrived and began treating the people in the other car.

They had my wife and I get in the ambulance with one of the people from the

other car. We were then transported to Sartori.

 

When we arrived at Sartori they took the person from the other car out first.

They then took my wife and I and placed us in a room. We had to wait for a

while, we had to call the baby sitter and let her know what had happened. We

then mad arrangements for a neighbor to take care of the kids until we got

home. I remember shaking and sometimes things were a little bit blurry.

 

Two police officers came in and asked if I would sign a waiver. I was a

little confused at the time. They did a breath test or breathing test. Later

they came an asked about the blood test. I was a little confused about them

taking the breath test and then asking for blood test. There was short period

when they had to find the kit for the blood.

 

The Doctor then treated the lacerations on my face, the also wanted to check

my neck. I did not feel that it was necessary for them to x-ray my neck as it

did not feel any different than it normally does. I then checked out of the

hospital and got a ride home from an officer.
