This Website is dedicated to Juli Ann who died less than 24 hours after receiving injuries when at night a speeding, drunken driver ran a flashing red light, broadsiding her and two friends. Juli was sixteen years old and a high school junior. Nearly two hours after the crash her killer's BAC was .087 (whole blood) and .120 (serum blood). Her killer was charged with vehicular homicide and serious injury by a motor vehicle, the State v. Tracy Allen Rokes, May, 1997. Rokes was acquitted of criminal charges by Judge Todd Geer at a nonjury trial. A toxicologist, Richard Jensen, testified to the defendant's blood alcohol based on the research of Kurt Dubowski, PhD. The toxicologist stated the defendant's BAC "could have been less than .087" at the time of the crash. This statement is preposterous. For Rokes' BAC to be higher later in the evening than at the time of the crash, he would have had to imbibe more alcohol after the crash. Rokes was acquitted. Later, during the civil proceeding, Kleinheksel v. Rokes v. Farrell, he was found 100% at fault, by a jury, April 22, 1999. Click here for Tracy Rokes' 10 explanations of what happened that night.

From the Offer to Confess Judgment:
"The collision occurred at the intersection of Highway 58 and Greenhill Road in Black Hawk County, Iowa. Juli was driving a motor vehicle southbound on Highway 58 when it was struck broadside by a motor vehicle driven westbound on Greenhill Road by Tracy Allen Rokes. Tracy Allen Rokes' vehicle was owned by his corporation, Rokes Building and Supply, Inc.

"At the time of the collision, Tracy Allen Rokes, was on his way home from a bar where he had been drinking beer with friends. An expert toxicologist retained by Juli's estate is of the opinion that at the time of the collision, Mr. Rokes' blood alcohol level would probably have been between .125 and .155% and that he would have had a greater than 50% probability of being 'frankly intoxicated'". This Web site was created to help other victims of drunken drivers become aware of informational reference and research resources available to them in hopes the drunken drivers will be made accountable for their actions. The second purpose is to collect and post information on the current .10 BAC law in Iowa hoping to effect a change in that law.
